statUP has created special policies and procedures for the online collection, use, and disclosure of information from children under 13 years of age, whether such collection occurs at the statUP website or through any other interactive or online method, including mobile applications (collectively, the “statUP Platform”). This statUP Children’s Privacy Policy (“Policy”) describes:

  • what types of personal information we collect from children on the statUP Platform
  • the purposes for which we use the information,
  • what rights you have regarding personal information you submit, and
  • to whom and under what circumstances we disclose personal information.

Platform Operators. The statUP Platform is operated by statUP LLC and certain service providers of statUP including, but not limited to, advertising, promotional, internet, sports association, and public relations service providers (collectively “Service Providers”). In this Policy, statUP and its Service Providers are referred to collectively as “we” or “our.” If you have any questions regarding this Policy or any other matter in connection with the statUP Platform, please contact:

Information Collection and Use

Non-Personal Information.

The servers from which we host and provide the statUP Platform collect and record certain non-personal information about site visits. The non-personal information that we collect may include IP addresses, the type of operating system in use, the type of browser being used by the visitor, the number and frequency of visitors to different elements of the statUP Platform, and the site the visitor was on immediately before accessing the statUP Platform.

We may provide children access to elements of the statUP Platform which do not require them to provide any personal information. As they use these elements, we may collect certain non-personal information by installing small text files known as cookies. We use cookies for several purposes, such as to recognize visitors to the statUP Platform, to determine the number of unique visitors to the statUP Platform, to ascertain which pages they visit or features they use, and to conduct internal evaluations of the statUP Platform. We may associate information we collect via cookies with the personal information we collect from or about children who access the statUP Platform, which we explain in the “Personal Information” section of this Policy. We may use the combined information, for example, to personalize your child’s experience on the statUP Platform or to personalize marketing communications we may send to your child. We may also allow unaffiliated third parties to place cookies on the hard drives of users of the statUP Platform.

You are always free to set your browser to decline cookies, but in doing so your child may not be able to use certain features of the statUP Platform. The “help” segment of the toolbar on most browsers will tell you how to configure your browser to not accept new cookies, how to have the browser inform you when you receive a new cookie, and how to erase cookies from your hard drive.

We may also use web beacons to count page visits by our users, to access our cookies, and otherwise to improve your experience on the statUP Platform. Web beacons (also known as clear gifs) are tiny graphics with a unique identifier, similar in function to cookies. Email messages that we send may also use web beacons to let us know which e-mails the recipients have opened and acted upon, allowing us to gauge the effectiveness of our communications and marketing campaigns. If you would like to opt-out of these e-mails, please visit the settings in your profile within the statUP Platform. Web beacons also help us manage online advertising, and are provided by our ad management Service Providers. These files enable our ad management Service Providers to recognize a unique cookie on your Web browser, which in turn enables us to learn which advertisements bring visitors to the statUP Platform. The cookie was placed by us, or by another advertiser who works with a service provider. With both cookies and web beacons, the information that we collect and share is anonymous and not personally identifiable. It does not contain your name, address, telephone number, or e-mail address. Our advertising Service Providers also use anonymous information about users’ visits to this and other platforms to deliver advertisements online that may be of interest to those users.

Personal Information.

We do not make a child’s participation in any statUP Platform site activity contingent on that child’s disclosure of more personal information than is reasonably necessary to participate in that activity. In order for any child to register on the statUP Platform, we may (as needed to provide the applicable features of the statUP Platform) collect the following information about your child:

  • first name
  • date of birth
  • gender
  • dominant hand/foot/eye
  • team name
  • coach name
  • school
  • sports club
  • zip code
  • parent’s e-mail address
  • password
  • secret question (as a reminder for a forgotten password)
  • username.

The statUP Platform requires you to create a parental account before your child is able to create an account and register with the statUP Platform. We require a parent or guardian to set up an account to reasonably ensure that the individual providing the consent is an adult. Once the consent of a parent or guardian has been verified, the account allows the parent or guardian to maintain control over the child’s account. To set up a parental account, we may collect the parent’s or guardian’s first name, last name, mailing address, date of birth, gender, and e-mail address. Additionally, we will require the parent or guardian to verify his or her identity via “digital signature” via e-mail. We may use the information collected about you and your child through the statUP Platform registration to inform you about future statUP promotions, sweepstakes, contests, third-party products and advertisements, and other marketing activities. We may use the team name, school name, zip code and username information collected about your child to rank your child’s performance on games and other competitions conducted on the statUP Platform.

We allow parents or guardians) to manage their children’s personal information or opt-in preferences within the statUP Platform. To manage this information and these preferences, visit your settings in your parent account on the statUP Platform. In this area, parents or guardians will be able to alter permissions, access the personally identifiable information that statUP has collected about their child, correct factual errors in such information, and request to have this information deleted or request that the statUP Platform no longer collect, use or maintain such information. To protect the privacy and security of statUP Platform members online, we will take reasonable steps to verify the identity of the parent or guardian before granting the parent or guardian access to the personal information that we collect and maintain about the parent or guardian and his or her child.

We may send service-related e-mails to statUP Platform members. These may include a welcome message and other non-promotional e-mails or text messages, from which no opt-out option is provided.

Disclosure of Information. The statUP Platform will transfer or otherwise disclose the information it collects from children or parents to employees and independent contractors of statUP, its subsidiaries, affiliates,[ and Service Providers] if the disclosure will enable that party to perform a business, professional, or technical support function for statUP, or if required to do so by law. These entities are restricted to using this information only to provide a service on our behalf. We do not share personal information with any third party for that party’s own promotional purposes. We will also transfer or otherwise disclose personal information in response to judicial process, to comply with legal requirements, and, as permitted under provisions of law, to provide information to law enforcement agencies or to third parties in connection with an investigation on a matter related to public safety or the security of the systems used to provide the statUP Platform. We may also use or disclose the information as permitted by law to protect our rights or property, the statUP Platform or its users.

Security of Information. We maintain industry-standard physical, electronic, and procedural safeguards designed to prevent unauthorized access to or disclosure of your personal information.

If the statUP Platform is Sold or Transferred. In the event that the statUP Platform or any of its assets are acquired by a third party, personal information acquired by statUP may be one of the assets transferred. In such an event, we will notify you as explained below under “Changes to this Privacy Statement”.

Third Party Platforms. To the extent that any of the third-party websites, apps, or other online services accessible through the statUP Platforms has different privacy practices from those stated in this Policy, those third-party privacy practices govern the collection and use of information you provide when visiting those platforms. We are not responsible for the policies, content, and practices of third-party platforms to which the statUP Platform may link and you should refer to those sites’ own privacy policies to learn how they collect and use personal information.

Changes to This Policy. By accessing the statUP Platform, you are agreeing to the practices described in this Policy. On occasion, it may be necessary for us to change the terms of this Policy. We will do so by posting updated text within the statUP Platform, and your continued use constitutes acceptance of those changes. To ensure that you are aware of current privacy practices, we recommend that you check the statUP Platform for such updates periodically. If your child is a member of the statUP Platform, you will be notified via e-mail if any of the changes affect the use of your own or your child’s personal information. You will be asked to opt-in to the new use of your child’s personal information. If your child is not a statUP Platform member, we will not materially change how we handle previously collected information without providing notice and an opportunity to choose how we use that information.
